The Service is provided to authorised persons or organisations (referred to in this document as "Subscriber" or "you"). Any use of the service is subject to any restrictions listed below. By using the Service, you agree to be bound by all of theses Terms and Policies. If you do not agree to be bound by these Terms and Policies, you must cancel your account immediately and may not thereafter use or attempt to use the Service.
Coverage - If you are an individual Subscriber, these Terms and Policies apply to all persons who gain access through your account. If you are a commercial Subscriber, these Terms and Policies apply to all your employees, agents and/or customers. In either instance, a violation of these Terms and Policies by anyone using your account will be treated as a violation by you.
Service Delivery - Shared / Reseller / WordPress / Application Hosting:
Shared and re-seller hosting accounts will be activated instantly on receipt of payment. Once paid, our systems will automatically provision your account and will notify you of any relevant setup / information.
Due to our fraud prevention systems – any order may be placed in a ‘Pending’ state awaiting confirmation / acceptance by management. This may cause delays and will prevent the automatic creation of the shared hosting accounts mentioned above.
Cloud / VPS / Dedicated and Other:
Services apart from those on our shared hosting environments will be provisioned manually within 48 hours following receipt of first payment.
Prices and Charges - BengalCloud provides the use of cPanel and domain control panels to you free of charge, but if through misuse or through abuse on your part we incur any charges, we reserve the right to pass these charges on to you.
Term - The Service is provided to you for as long as you wish to use it, however we withhold the right to terminate the service if you use it in a way that violates the terms of use.
Backups - BengalCloud carry's out 1-4 backups per day. These backups are strictly for our own use in-case of a server failure. However, you can also ask for the backup to restore your files. This is not meant as a replacement for keeping your own backups and we are not responsible for loss of data. Always, you have to confirm that you have your own backups.
Again, we are not responsible for loss of data!
Also, We reserve the right to remove any backups you create and store locally.
Your Responsibility - You are required to use our network responsibly and with respect for our other clients. We reserve the right to suspend and/or cancel your service if you use our network in such a way that adversely affects other customers.
While we may monitor services electronically to determine that systems are operating correctly, as a general practice, we do not monitor your communications or activities to determine if they are in compliance with the policy.
However, when we are notified of a violation of this policy, we will take action to stop or correct the violation, including, but not limited to, denying access to our services and equipment. In addition, we may take action against you or one of your clients depending on the type of violation.
If you resell and offer Internet services, you will cooperate with us in any corrective or preventive action deemed necessary. Failure to cooperate is a violation of this policy and we reserve the right to take action which may also affect your other customers or web sites.
Inactive Accounts - Accounts in a suspended status for longer than 30 days will be deemed inactive and will be terminated automatically.
Accounts that do not resolve to our servers (either through DNS, A-Records, MX records or CloudFlare) will be seen as a file storage account and the following timeline will apply:
Notification sent at 14 days inactive
Account suspended at 30 days inactive
Account terminated at 30 days inactive
Server Resources - Any website that is deemed to be using a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources) will be given the option to either pay for additional resources (depending on which resource is required), reduce the resources used to an acceptable level or upgrade to a Virtual Private Server. We will be the sole arbiter of what is considered to be a high server usage level. Any Website Hosting, WordPress Hosting (and individual clients) account deemed to be adversely affecting server performance or network integrity will be suspended without prior notice.
Viruses Uploaded to Websites - If your website contains a virus or a virus has been uploaded by the website owner or if the website is hacked in anyway, our system will automatically attempt to clean the virus, if this does not happen our system will then attempt to delete the virus. If the virus can not be deleted and several viruses are uploaded your domain name will be suspended from our hosting. You may be charged an administration fee of TK 2,500.00 to have the domain name re-enabled.
Service Level Agreement - If your service drops below 99.9% uptime in any given month you will be credited 10x the amount of downtime to your account. This must be claimed within 7 days of our monitoring dropping below this level.
Any planned maintenance work is except from this guarantee and will be ignored.
Uptime level is calculated by our status page and monitors only.
Downtime occurring due to natural disasters or DDoS attacks against the network do not count towards the SLA calculations.
Spamming - Sending unsolicited bulk and/or commercial messages over the Internet (known as “spamming”) is prohibited, regardless of whether or not it overloads a server or disrupts service to our customers.
The term “spamming” also includes, but is not limited to, maintaining an open SMTP policy, engaging in spamming using the service of another ISP or IPP and referencing in the spam a web site hosted by us, and selling or distributing software (on a web site residing on one of our servers) that facilitates spamming.
Violators may be fined and will face immediate suspension. We reserve the right to determine, at our sole and absolute discretion, what constitutes a violation of this provision.
Mass Mailing - Mass mailing / mailing lists is not allowed on our Website Hosting and Reseller Hosting mail service.
Anyone who sends mass mail and is found to cause issues to our mail service or IP reputation will be given a fine (details below) and have the domain name suspended.
Those who are found to be sending masses of spam emails will be given a flat fine to cover administration time for The Hosting Heroes to physically remove the emails from our spool.
Any email spam /bulk user that causes IP black listings will be given a fine of TK 10,000.00.
Any user that causes complaints from other companies, for example spamcop, AOL, yahoo etc. will be given a fine of TK 5,000.00 to cover administration fee’s for us to advise the companies the reasons why the spam was sent.
The standard fine for sending spam emails are TK 2,500.00.
Changes to the Website and these Terms of Use - We may change or update the Website and its content at any time without notice to you. However, please note that any content on the Website may be out of date at any given time, and we are not under any obligation to update that content.
We may change these Terms of Use at any time without notice to you. If we do change these Terms of Use, we will post the updated Terms of Use on the Website. It is your responsibility to check the Website from time to time to see if there have been any changes to these Terms of Use. Once any updated Terms of Use are posted on the Website, your continued use of the Website will be considered to be your acceptance of those updated Terms of Use.
1. Shared hosting space is intended solely for web files, active email accounts, and the content of User Websites. It must not be used for general storage, including media, email, or other data, nor for offsite storage of electronic files, email, or FTP hosts. BengalCloud reserves the right to review all shared accounts for excessive CPU usage, disk space consumption, and other resource-intensive activities that may indicate a breach of this Agreement or our Acceptable Use Policy. At our discretion, we may terminate access to services or remove user content from accounts that violate these terms.
2. Our shared hosting packages are designed for personal websites, small business websites, and self-managed email services. These plans are not suitable for hosting email services for large businesses or enterprises, or for running applications that are better suited to cloud or dedicated servers.
3. To maintain a high-quality experience for all users, BengalCloud applies a threshold (soft limit) of 10 GB total storage (including email storage) per website account. This limit prevents any single account from expanding too rapidly and negatively impacting system performance. If you reach this limit while legitimately using your account, please contact us, and we will assess your resource needs. These limits apply exclusively to plans labeled as "unlimited space."
4. You are not permitted to use the unlimited hosting space for storing or sharing files unrelated to your website. Storing backup files on our servers is strictly prohibited, and any such files will be removed immediately upon detection without notice. Additionally, storing or sharing MP3s, music, videos, images, or other file types is not allowed under our unlimited plans.
5. Sending bulk, promotional, marketing, or any unsolicited emails is strictly forbidden on our shared hosting plans. Furthermore, email accounts within our unlimited hosting plans are capped at a maximum of 1 GB per email address.
